| Paddack Wins AMA Award

Recently
profiled state Senator Susan Paddack (Winter 2009 issue
of Connections) was honored by the American
Medical Association (AMA) with one of the 2009 Dr.
Nathan Davis Awards for Outstanding Government
Service. Paddack accepted the honor at the Dr.
Nathan Davis Awards gala held March 10, 2009 at the
National Advocacy Conference. Joseph M. Heyman,
chair of the AMA Board of Trustees said Paddack was
honored for her dedication in removing barriers to
health care access for the people of
Oklahoma. The AMA Alliance nominated
Paddack for this award. It is recognized nationally
as one of the most prestigious honors extended to
elected officials and career government employees for
outstanding endeavors that advance public health.
Paddack thanked her husband, the Alliance
and the family of medicine during her acceptance
speech. She credited her experience including the
2000-01 Alliance presidency; "during this span of time I
received incredible training on legislative advocacy,
health care policy discussions and public speaking, all
which empowered me with the skill sets that enabled me
to run for office." Paddack also encouraged
everyone to "take this leap of faith to run for office,
or to help others run because we need more
members from our family of medicine to be a part of the
solution." |
FTC Asserts Red Flags Rule Applies to
Physicians IMS joined 98 other
groups in protesting application of the Red Flags Rule
to physician practices. However, the FTC maintains that
the Rule applies to physician practices that "regularly
defer payment for goods or services." The FTC believes
compliance does not impose significant burdens upon
physicians and can protect patients from medical
identity theft. The AMA continues to advocate against
this but also is developing educational tools to assist
physicians with medical identity theft prevention
measures. IMS also plans to offer a webinar on this
issue, including discussion of the Red Flags Rule.

Advocacy
Resource Center
The Advocacy Resource Center (ARC) was created in
1997 as a partnership between the AMA and state medical
associations. The ARC's mission is to enhance and
advance the collective state legislative advocacy
efforts of organized medicine. All state medical
associations are members of the ARC.
The ARC is governed by 19 Executive Committee
members from state medical associations. The Executive
Committee meets formally twice a year and by telephone
several more times a year to determine the focus of ARC
campaigns based on legislative trends and priorities of
its members. AMA staff implements the ARC campaigns in
consultation with the Executive Committee.
The ARC is a successful collaboration between
and among the AMA and the state medical
associations. By sharing strategies and developing
focused campaigns, the ARC shows that together we are
stronger.

TRENDTrack, which provides a comprehensive 50-state
compilation of real time legislative developments, as
well as an interactive map, on issues that concern
organized medicine.

NCMS,
AMA and other Medical Societies Add WellPoint to UCR
Lawsuits On March 25, 2009 a class action
lawsuit was filed in the federal court in California
alleging that WellPoint engaged in a conspiracy with
other health plans to underpay physicians for
out-of-network services, with financial consequences to
both physicians and their patients. Similar lawsuits
were filed against Aetna, Inc. and CIGNA Corporation in
February 2009. The three lawsuits allege a conspiracy
with Ingenix, a division of United Healthcare, to fix
prices and set artificially low prices to be paid to
non-participating physicians. The lawsuits follow an
investigation by New York Attorney General Andrew Cuomo
demonstrating intentional rigging of the Ingenix
database to shortchange reimbursements. The AMA,
California Medical Association, Connecticut State
Medical Society and Medical Association of Georgia have
also joined the WellPoint lawsuit. WellPoint has
significant presence in North Carolina as a result of
the large number of "Blue Card" retirees, and
WellPoint's acquisition of Anthem, which previously
operated in Virginia. As a plaintiff, NCMS will have
significant input into the discovery processes, conduct
of the lawsuit, language of any settlement agreement,
compliance processes, and remedies or penalties. To read

Winner
Although I have always been interested in politics,
the impetus I needed to become active in the 2008
campaign was attending AMPAC Campaign School in April
2007. When Dr. Teresa Bratton filed to run for
United States Congress from North Carolina's 6th
District, I joined her steering committee. Dr.
Bratton, a pediatric-allergist, has worked on behalf of
children and on environmental issues for many
years. However, with no prior campaign experience,
no political war chest, no name recognition in the
political arena, her challenge was huge since she was
opposing a 12-term incumbent. My major role
was "event planning", including hosting a fundraiser in
my home in June - "Doctors for Bratton". I
organized fundraisers and meet-and-greets in the homes
of five physicians throughout our 6-county
district. These were not for physicians only, but
we tried to contact as many medical families as
possible. I coordinated one other major
fundraiser in September and organized poll workers for
Early Voting and Election Day. Because the
campaign was such a grassroots effort, our small - but
committed - team campaigned door-to-door, worked phone
banks, delivered yard signs, worked at the
polls...whatever was necessary.
Although the odds were not in Dr. Bratton's favor,
she was an excellent candidate. She didn't
win, but her run for Congress brought attention to the
need for affordable health care and for a healthy
environment.

Chenault Award for Political Participation recognizes an
AMA Alliance member for outstanding accomplishment
through volunteer activities in a political campaign or
state ballot
initiative. | |

Advocacy Survey
Results
A survey of 420
state and county Alliance presidents, presidents-elect
and state and county legislation chairs provides
valuable insight on local and national advocacy efforts
and opportunity through AMPAC and local PACs. Following
is a summary of our findings based on the top three
ratings totals in a scale from 1 to 5:
- Although "Reform the Medicare
physician payment system" was rated highest by a
majority of respondents (77%), a look at overall
responses in the top three ratings categories showed
surprisingly that the so-called "pocketbook" issues
are not a top advocacy priority with
Alliance members.
- The number one issue that
Alliance members are concerned with is
"Expanding coverage for the
uninsured" (98%), followed by "Ensuring that
physicians, not others, set quality standards" (95%).
- While 64% of respondents
reported they are local PAC members; conversely, 64%
reported they are NOT members of the AMPAC.
- 77% of Alliance members who
responded report they speak for their physician spouse
on advocacy legislation.
- Over half of all respondents
(57%) visit the AMA Alliance Web site for advocacy
information, while about one quarter (26%) visit the
AMA's Advocacy Resource Center
site.
